Can Trump Impose Tariffs on Day One ?
President-elect Trump has proposed sweeping tariffs, including a blanket 10â20% tariff on all imports, up to 100% on Chinese goods, and 25% on imports from Mexico and Canada. He suggests implementing some tariffs immediately. Can he do this? Potentially, yes.
The US Constitution grants Congress the power to impose taxes, including tariffs. However, Congress has delegated significant authority to the executive branch through trade laws, allowing presidents to impose tariffs without congressional approval. This unique executive power circumvents the checks and balances typically applied to economic policies, enabling swift action.
Two primary mechanisms exist for imposing tariffs. First, trade laws from the 1930s-70s permit tariffs to protect U.S. workers from unfair trade practices. These require investigations by the Department of Commerce or US Trade Representative and a public notice period, making immediate tariffs unlikely.
Second, the International Emergency Economic Powers Act (IEEPA) of 1977 allows the president to act swiftly in response to âextraordinaryâ threats.
